In early 1989, the state charged sixteen-year-old Byran Perotti as a juvenile delinquent for murder and related offenses, and petitioned for waiver of juvenile jurisdiction to allow Perotti to be prosecuted as an adult. Superior Court Judge Jay Hodges presided over the waiver proceedings and ordered juvenile jurisdiction waived. Perotti later entered a plea of no contest to a charge of first-degree murder. Judge Hodges sentenced him to a term of ninety-nine years. Perotti appeals, contending that Judge Hodges erred in declining to recuse himself from the sentencing hearing after having presided over the juvenile waiver proceedings. We reverse.
